1) Eligibility (17+)
The Service is intended for users age 17 and older.
By using the Service, you represent that:
- you are at least 17 years old, and
- you have the legal capacity to enter into these Terms.
If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the Service.
2) The Service
Vibez is the ultimate platform for sharing and discovering stunning nail art through creative video content. Join a vibrant community of nail artists, beauty creators, and enthusiasts showcasing unique designs, techniques, and the latest manicure trends.
We may add, modify, suspend, or discontinue any part of the Service at any time.
3) Accounts
3.1 Registration
To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information (including name if provided, username, and email address) and to keep it updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.
3.3 Termination
We may suspend or terminate your account if we reasonably believe you violated these Terms or if we must do so to comply with law or protect the Service or others.
4) User Content and Community Features
"User Content" means any content you upload, post, submit, or otherwise make available through the Service,
including videos, photos, text, captions, and comments. You retain ownership of your User Content, subject to
the license you grant below.
4.1 License You Grant to Vibez
To operate and provide the Service, you grant Vibez a worldwide, non-exclusive, royalty-free, sublicensable
(to our service providers), and transferable license to host, store, reproduce, modify (for formatting and
technical purposes), distribute, publicly display, and perform your User Content, and to create derivative
works from it, solely for:
- operating and improving the Service,
- enabling sharing to other users as directed by your in-app settings and actions, and
- promoting the Service (for example, featuring content within the app or on our official channels).
This license ends when you delete your User Content or your account, except to the extent your content has
been shared with others and they have not deleted it, or where we must retain it for legal or safety reasons.
4.2 Your Responsibilities
- you have all necessary rights to upload and share your User Content,
- your User Content does not infringe or violate any third-party rights, and
- your User Content complies with these Terms and applicable law.
Some features may allow content to be public or visible to other users. Your settings and actions determine visibility within the Service.
5) Prohibited Conduct
You agree not to:
- violate any applicable law or regulation;
- post or share illegal, harmful, hateful, harassing, defamatory, obscene, or otherwise objectionable content;
- exploit or harm minors or attempt to do so;
- impersonate any person or entity or misrepresent your affiliation;
- interfere with or disrupt the Service or its security features;
- attempt to access non-public areas, accounts, or systems without authorization;
- scrape, crawl, or use automated means to access the Service except as permitted by us in writing;
- upload malware or engage in phishing, spamming, or similar abuse;
- infringe intellectual property or privacy rights of others.
6) Location Features
If the Service offers location-based features, you can choose whether to grant permission for precise or
approximate location in your device settings. Your choice may affect certain features.
7) Photos, Face Data, and Biometrics
No face recognition / biometrics. We do not perform face recognition or create biometric identifiers or
biometric information from your photos or videos.
If you choose to use features that process photos or text (for example, generating outputs, previews, or
edits), any server-side processing is limited to providing that feature and is designed to be one-time and
promptly deleted after processing is complete.
8) Third-Party Services
The Service may include integrations or links to third-party services. We do not control those services, and
your use of them is governed by their terms and policies. Vibez is not responsible for third-party services.
9) Intellectual Property
Except for User Content, the Service and its content, features, and functionality (including software,
designs, trademarks, and logos) are owned by Vibez or its licensors and are protected by applicable laws. You
may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service
except as allowed by law or expressly permitted by us.
10) Privacy
Our privacy practices are described in our Privacy Policy. By using the Service, you acknowledge that we process information as described there.
11) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEZ
DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content will be available or accurate.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES,
ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEZ’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO
THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VIBEZ FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT
GIVING RISE TO THE CLAIM (OR, IF YOU PAID NOTHING, USD $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13) Indemnification
You agree to indemnify and hold harmless Vibez Team and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- your use of the Service,
- your User Content,
- your violation of these Terms, or
- your violation of any rights of another.
14) Governing Law
These Terms are governed by the laws of Vibez Team’s principal place of business, without regard to conflict
of law principles, except where prohibited by applicable law.
15) Dispute Resolution and Binding Arbitration
Important: This section affects your legal rights, including the right to go to court and to have a jury trial.
15.1 Informal Resolution
Before filing a claim, you agree to try to resolve disputes informally by contacting us at
dothikimthu0223@outlook.com and providing a brief description
of the issue and your contact information.
15.2 Binding Arbitration
If we cannot resolve a dispute informally, you and Vibez agree to resolve any dispute, claim, or controversy
arising out of or relating to these Terms or the Service through binding arbitration, rather than in court,
except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction
to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights
or to protect security and integrity.
15.3 Arbitration Procedures
The arbitration will be conducted on an individual basis. The arbitrator may award the same remedies as a
court could award. The place and governing procedural rules for arbitration will be determined based on
Vibez Team’s principal place of business unless applicable law requires otherwise.
15.4 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, you and Vibez agree that each may bring claims against
the other only in an individual capacity, and not as a plaintiff or class member in any purported class,
collective, or representative proceeding.
16) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the
Service or by other appropriate means. The Effective Date above indicates when these Terms were last updated.
Your continued use of the Service after the effective date of an updated version constitutes acceptance.
